If The Shoe Fits…

Just a short and sweet post today…U.S. Customs and Border Protection (CBP) has published a recently revised Informed Compliance Publication (ICP) entitled, “What Every Member of the Trade Community Should Know About:  Footwear“.  The ICP’s are published by CBP and are provided for general information purposes only.

However, it is important to keep current with these publications, as applicable and when relevant to your business, as part of an importer’s responsibility to exercise reasonable care.  This concept of reasonable care was one of the most significant effects of the Customs Modernization Act (the Mod Act), also known as Title VI of the North American Free Trade Agreement Implementation Act (Pub. L. 103-182, 107 Stat. 2057).

The Mod Act espoused two important concepts:  informed compliance and shared responsibility.  These two concepts are based upon the idea that in order to “maximize voluntary compliance” with Customs’ laws and regulations, the trade community must be clearly informed and must understand its legal obligations under those laws and regulations.  As result, the Mod Act subsequently placed the onus on CBP to “provide the public with improved information concerning the trade community’s rights and responsibilities under customs regulations and related laws.”  As part of that responsibility, CBP developed and publishes this series of ICP’s on new or revised requirements, regulations or procedures and has addressed a number of classification and valuation issues.
